§ 69-30. Penalties for offenses.

  • A. 
    Except for a violation of § 69-4, an infraction by any person of the provisions of this chapter shall be a violation punishable by a fine not to exceed $250 or imprisonment for a period not to exceed 15 days, or by both such fine and imprisonment for conviction of a first offense; by a fine of not less than $350 nor more than $1,000 or by imprisonment for a period not to exceed 15 days, or both, for conviction of the second of two offenses, both of which were committed within a period of five years; and by a fine of not less than $1,000 nor more than $5,000 or by imprisonment for a period not to exceed 15 days, or both, for conviction of a third or subsequent offense of a series of offenses, all of which were committed within a period of five years.

    B. 
    In addition to the penalties provided above, any violation of § 69-14A, C, D, E or G of this chapter shall subject the person committing such an offense to a civil penalty in the amount of $10,000 for each day that the offense shall continue, collectible by and in the name of the Town of North Hempstead.
    C. 
    Any person who violates § 69-4 of this chapter shall be guilty of a Class B misdemeanor punishable by a fine not to exceed $500 or by imprisonment for a period not to exceed three months, or by both such fine and imprisonment. Any subsequent violation of § 69-4 by the same person within three years shall constitute a Class A misdemeanor punishable by a fine not to exceed $1,000 or by imprisonment for a period not to exceed one year, or by both such fine and imprisonment.
