§ 49-6. Procedures during snow emergencies.

A.The Superintendent of Highways shall prepare and may from time to time amend a map of Town highways to be designated as snow emergency routes. Such map and any amendments thereto shall be filed with the Town Clerk, who shall cause a descriptive summary thereof to be published once in the official newspapers of the Town. The designation of such highways as snow emergency routes shall take effect upon the publication and posting by the Superintendent of Highways pursuant to Subsection D of this section and shall continue until modified.B.The Supervisor may declare a state of snow emergency whenever, in his judgment, snow has created or will create dangerous driving conditions within the Town. The snow emergency shall take effect upon notification of the declaration to the appropriate media for release to the public. A like procedure shall be followed to effect the termination of the snow emergency.C.Notwithstanding any other laws, ordinances, rules or regulations to the contrary, during the existence of a snow emergency, no vehicle may be parked or abandoned upon any snow emergency route, and no vehicle may travel upon any snow emergency route unless it is equipped with snow tires or chains.D.The Superintendent of Highways shall erect and maintain appropriate signs at reasonable intervals along designated snow emergency routes to provide notice that it is unlawful to park or abandon any vehicle or travel in a vehicle not equipped with snow tires or chains along snow emergency routes during a snow emergency.E.Any vehicle parked or abandoned in violation of the provisions of this section shall be deemed a nuisance and a menace to the safe and proper regulation of traffic. The Superintendent of Highways, his employees or any peace officer may remove or cause to be removed any such vehicle to any other location within the Town without any liability for damage to the vehicle. The owner of such vehicle shall be required to reimburse the Town for the actual and necessary cost of removal and storage thereof before he is entitled to regain possession. Such reimbursement shall be in addition to any penalty for violation of this chapter as set forth in § 49-11.[Amended 11-15-2011 by L.L. No. 14-2011]
