§ 42-20. Navigational aids.

  • A. 
    It shall be unlawful and a violation of this section and an offense within the meaning of the Penal Law of the State of New York for any person without written permission from the Director of Harbor and Marine Enforcement or from the United States Coast Guard:
    (1) 
    To move, moor to, deface or remove any navigation marker buoy or Town informational sign in the waterways.
    (2) 
    To moor to, trespass, deface, or cause damage or harm to a lighthouse or its surrounding property.
    B. 
    Notwithstanding the provisions of § 42-19 of this chapter, any person committing a violation of this section shall be punished:
    (1) 
    By a fine of $1,000 or by imprisonment for a period not to exceed 15 days, or both, for conviction of a first offense.
    (2) 
    By a fine of $2,000 or by imprisonment for a period not to exceed 15 days, or both, for conviction of the second of two offenses, both of which were committed within a period of five years.
    (3) 
    By a fine of $5,000 or by imprisonment for a period not to exceed 15 days, or both, for conviction of the third or subsequent offense of a series of offenses, all of which were committed within a period of five years.
