§ 2-74.1. Number of meters; exemptions.

  • A. 
    No dwelling which may be lawfully occupied by only one family in accordance with Chapter 70 of the Town Code shall have more than one electric or gas meter located therein or elsewhere on the property so as to service such dwelling. The occupancy of any dwelling shall presumptively be limited to one family unless a certificate of occupancy or certificate of existing use permits occupancy by more than one family. A dwelling for which a conditional use permit has been granted for use as a mother-daughter residence shall be treated as a one-family dwelling.
    B. 
    No dwelling which may be lawfully used as a two-family dwelling in accordance with Chapter 70 of the Town Code shall have more than two electric or gas meters located therein or elsewhere on the property so as to service such dwelling.
    C. 
    Any person that configures or reconfigures the electric wiring or gas piping to facilitate the installation of a second or third meter at any dwelling and any public utility that installs a second or third meter shall provide written notification to the Commissioner of Buildings of the Town of such configuration, reconfiguration or installation within 15 days of the performance of such work, including in such notification information as to the type of meter, the name of the applicant for the meter and the address of the dwelling at which the work has been performed.
    D. 
    The owner of any dwelling at which an electric or gas meter is installed subsequent to the effective date of this section in violation of either Subsection A or B of this section shall be liable for the penalties for violations of this chapter for each week that the nonconforming meter remains in use after the Department of Buildings has sent to the owner a notice of violation of this section. The owner of any dwelling which has a nonconforming electric or gas meter as of the effective date of this section shall, as of February 1, 1996, be liable for the penalties for violations of this chapter for each week that the nonconforming meter remains in use after the Department of Buildings has sent to the owner a notice of violation of this section.
    E. 
    Any person subject to this section may seek exemption for good cause from the requirements of this section by making application to the Commissioner of Buildings. If the Commissioner shall find that compliance with this section would cause undue hardship or undue expense even with the dwelling in question being occupied in accordance with the requirements of Chapter 70 of the Town Code, he may grant an exemption. A person may seek review of a denial of an exemption by the Building Commissioner by application to the Town Board, on a form to be supplied by the Commissioner.
